PRBA Lease Termination Notice Changes

HUD Policy Update
The U.S. Department of Housing and Urban Development (HUD) has issued a new rule that changes the notice requirements for non-payment of rent. During the COVID-19 pandemic, Housing Authorities were required to provide 30 days' notice before terminating a lease for non-payment of rent. HUD has now rescinded that temporary rule.

Revocation of the 30-Day Notification Requirement Prior to Termination of Lease for Nonpayment of Rent. All information as listed below.

What This Means
Beginning in 2026, HUD regulations return to pre-pandemic requirements.

For PBRA, the required notice for non-payment of rent will be:
At least 14day written notice before lease termination.

  • Rent due: first (1st) of the month
  • Rent is late after the fifth (5th) of the month
  • $15 late fee applied on the sixth (6th) of the month
  • Court filing after the 14th on any resident account with a balance due

When This Change Will Take Effect at BDCIC
BDCIC will implement this change after providing notice to residents.

The expected implementation date is June 1, 2026
Until that time, we will continue following the 30-day notice practice currently in place.
